General Terms and Conditions (AGB)
1. scope of application
These general terms and conditions are applicable to all offers of the ILS as well as in its premises.
2. our code of conduct
It is very important to us to be able to offer you as a customer an optimal solution for any problems concerning your course at any time. If you have any questions, please contact our secretariat at any time and without obligation.
3. absences from private lessons
3.1 The agreed teaching times are binding. If it is not possible to keep the appointment as agreed, the secretary's office or the teacher must be informed at least 24 hours before the course date. After that, the secretariat or the teacher will try to arrange an alternative date with the help of the secretariat or the teacher.
3.2 Absences reported after 24 hours prior to the course date cannot be considered and will be invoiced in full.
3.3 In exceptional cases such as illness and accident (upon presentation of a medical certificate) or death, the cancelled lesson may be made up for.
4. absences from group lessons
4.1 If a group course cannot be attended by the student, the secretariat must be informed as soon as possible. The costs will be charged in full.
4.2 In extraordinary cases such as illness and accident (upon presentation of a medical certificate) or death, a credit note will be issued for the missed teaching time. With this you can make up the time you missed in another course offered by us at the ILS (at the same location).
5. absences of the teacher
In case of absence of the teacher (e.g. illness) the ILS reserves the right to organise a substitute. If this is not possible for organizational reasons, an attempt will be made to postpone the date. If it is not possible to reschedule the course, you will receive a credit for the missed class time. With this you can make up the missed time in another course offered by us at the ILS (at the same location).
With your signature or your consent to our terms and conditions (online or in writing on site) you register bindingly for the respective course.
7. continuation of the course
The course registration is not automatically renewed, but expires after the duration of the course you have booked. Therefore, if you would like to continue the next course, register early for it.
8. billing of attended lessons
Should you attend further lessons at the ILS after the end of your booked course, we reserve the right to charge you for the lessons you attended even without registration.
9. cancellation of the course before the start of the course for group courses
9.1 Participants can cancel a booked course up to 14 days before the start of the course (valid is the date of course start on the registration confirmation) without additional costs. Cancellations made after this deadline will not be considered and will be charged in full.
9.2 In exceptional cases such as illness and accident (on presentation of a medical certificate) or death, the ILS will be happy to issue a credit note. With this you can make up the time you missed in another course offered by us at the ILS (at the same location).
9.3 Course participants from abroad must pay the course fees at least 30 days before the start of the course. In the event of non-payment of the course fees, the course registration will be considered invalid and the participant will not be able to take part in the course.
Exception: In case of a negative visa decision, we accept course cancellations up to 14 days before the start of the course (valid is the date on the confirmation of registration) and only charge a circumstance compensation of CHF 250. If you are unable to attend the course due to a refused visa, please contact us immediately and present us with the negative visa decision of the responsible consulate or authority.
Refunds and cash payments of payments already made are excluded in any case.
10. price drop
Should you have to cancel a course for an important reason such as illness and accident (upon presentation of a medical certificate) or death, the ILS will be happy to issue a credit note for the missed lessons. With this you can make up the missed time in another course offered by us at the ILS (at the same location). Price drops without important reason are not taken into account. Refunds and cash payments are excluded in any case.
11. trial lessons
11.1 At ILS-Bern and ILS-Solothurn, you have the opportunity to attend a trial lesson of 2 lessons (90 minutes) in both group and private lessons. The trial lesson is non-binding and does not oblige you to register. If you do not continue with the course, the trial lesson is free of charge. In case of a booking, the trial lesson will be charged.
11.2 At ILS-Basel you have the opportunity to attend a free trial lesson of 45 minutes in all courses. The trial lesson is non-binding and free of charge.
Delays on the part of the participants will not be considered. If the teacher is late, the teaching time will be made up individually by arrangement.
13. expiry date vouchers and other lessons
Vouchers have a maximum validity period of one year. Purchased and unattended private lessons expire three years after the date of purchase. After this time, vouchers and unattended lessons can no longer be redeemed.
14. level completion
The regular completion of a course at the end of the booked course period does not guarantee a successful completion of the level. Please refer to our guidelines on the duration of a level qualification under the Common European Framework of Reference for Languages (CEFR). How quickly you complete a level depends on your individual performance and commitment. The ILS assumes no responsibility for this.
15. online courses during officially ordered school closures
15.1 All ILS courses are continued online during officially ordered school closures. For this purpose we use the video communication portal Zoom.
15.2 In the event that participants do not wish to take part in online lessons, we will issue a credit note for the remaining course time, which can be redeemed on site after resuming the classroom courses.
15.3 Cash payments or refunds for unattended courses during officially ordered school closures are excluded in any case.
16. online courses
16.1 For all online courses, the same provisions apply as for face-to-face teaching. This applies in particular to the cancellation of appointments, we refer here to sections 3 and 4 above.
16.2 Courses that have been converted into online courses as a result of the corona crisis will again take place on site as soon as the Confederation lifts the measures to combat the corona virus.
16.3 All courses that have been held online from the beginning will continue to be held online after the federal measures have been lifted. 16.4 Only applies to registrations for courses that take place temporarily or permanently online: Instructional materials are ordered online independently by customers. No costs for teaching materials will be charged.
17. telc examinations
17.1 Cancellations before the end of the registration and cancellation period are free of charge. In the case of cancellations after this deadline, the examination fees will be charged in full. The examination fees vary according to the level.
17.2 You can register retrospectively up to 12 days before the examination. If you register after the registration and deregistration deadline, you will be charged a late registration fee of CHF 50.
17.3 With your booking you also confirm that you have read our General Terms and Conditions (ILS) as well as the General Terms and Conditions of telc gGmbH and that you agree to both. The General Terms and Conditions of telc gGmbH are enclosed.
17.4 The ILS does not take responsibility for missed or failed examinations. The examination fees are due in any case.
17.5 Anyone who is late for the examination on the day of the examination will be excluded from the examination and will not be able to take it. The examination fees must be paid in full.
17.6 In the event of non-payment of course or examination fees, ILS reserves the right to withhold telc certificates until the invoice has been settled.
18. fide test
18.1 A cancellation fee of CHF 50 will be charged for cancellations up to 21 days before the examination date. For cancellations less than 21 days before the start of the examination, the examination costs must be paid in full.
18.2 The fide test is a progressively structured language test. The ILS declines all liability for results that do not meet the target level.
18.3 In the event of non-appearance or late arrival on the day of the examination, the examination fees must be paid in full. Late participants may be excluded from the examination.
18.4 By making a booking, you confirm that you agree to both our General Terms and Conditions (ILS) and the Regulations for Participation in the fide Test (fide).
19.1 The school management reserves the right to dispose of course places that have not been paid for at the start of the course. For organisational reasons, ILS reserves the right to postpone, reallocate and combine classes.
19.2 Group courses that are not booked with at least two participants per group by the Thursday before the start of the course may be cancelled at short notice by the school management. The registration for the corresponding course remains postponed or refunded in the form of a credit note for the amount already paid. If desired, a refund of the amount can be made.
19.3 ILS reserves the right to record images and video footage of participants on ILS premises and on excursions and trips. This may be used for advertising purposes on our website. If you do not wish this to happen, please contact our secretariat or the management immediately. Your data will not be passed on to third parties.
19.4 We take complaints of any kind very seriously. We always try to find a mutually satisfactory solution. However, in the event of dissatisfaction with the teacher or the lessons, there is no entitlement to compensation, refunds or reductions. Restructuring of courses (e.g. change of teacher) will only be made in particularly serious cases.
20.1 ILS clients undertake not to enter into any employment relationship with ILS instructors while courses are in progress at the ILS or for one year after completion of their last course. In the event of non-compliance with this provision, ILS reserves the right to charge the client a compensation fee of CHF 2,000 per teacher.
20.2 ILS instructors undertake not to enter into any employment relationship with (former) ILS clients, both during their employment relationship with ILS and for a period of one year after termination of their employment relationship with ILS. In the event of non-compliance with this rule, ILS reserves the right to claim compensation in the amount of CHF 2000 per client.
21. terms of payment
On request you can pay the course fee in instalments. The payment date stated on the invoice is binding. In the event of late payment, we reserve the right to charge a compensation of CHF 20 each for the 2nd and 3rd reminders.
22. teaching aids and course materials
The costs for teaching materials and other course materials are not included in the course price, but will be charged separately.
23. placement test
If you have any previous knowledge, please come to us for a free and non-binding placement test and a subsequent consultation. The final classification of the course takes place after the placement test or after a consultation.
24. telephone and e-mail communication
With your consent, we will be happy to communicate with you via e-mail or telephone. For this purpose, we use the e-mail address or (mobile) phone number you have provided.
25. data protection
We take the protection of your personal data seriously and comply with the provisions of the Data Protection Act. Please read our data protection regulations on our homepage. With your consent to our terms and conditions, you accept that we may process and store any data you provide when registering within the framework of our business processes.
For all courses, examinations and events organized by us, we exclude any liability for damages incurred. You are therefore responsible for ensuring that you have adequate insurance cover. We accept no liability for theft or loss of items on ILS premises.
27. place of jurisdiction
The provisions of Swiss law shall apply to everything else. Place of jurisdiction is Bern.
